TERMS & CONDITIONS

1) Identification

ProteanArt is a Company in England and has a registered office in England.

The www.proteanart.com website, hereafter know as The Site, is for informational and commerce purposes for the products of ProteanArt only.

All courses and products are designed and made by ProteanArt in the United Kingdom (England).

Workshops, School projects, Art Materials and other art-related items are offered for sale on The Site.  

ProteanArt does not sell, deal or otherwise interact with fur products, endangered species leathers or items widely seen as unethical or exploitative.

The Site shall not be responsible or liable for the accuracy, usefulness or availability of any information which is not directly related to the business and products of ProteanArt.

2) Intellectual property

All our websites and their original content, designs, products, logos, graphic designs, features, and functionality are owned by ProteanArt and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

3) Sales & Payment

All products, whether a physical product, a service or an educational workshop, are offered for sale by ProteanArt only.  

This Site accepts payments by debit or credit card and such payments are processed through secure third party payment platforms.  (See our Privacy Policy)

Sales through www.ProteanArt.com are processed via one of the following:

The shopping experience on The Site will be via an online ‘Shopping Cart’ method. 

Proceeding from ‘Cart’ to ‘Checkout’ customers are given the choice to complete purchases via one of these payment portals.

Orders finalised at ‘Checkout’ will be taken as a firm request for those products offered on The Site.  

ProteanArt will make and dispatch orders in good faith that the contact details and shipping addresses given are accurate.  Liability for all subsequent loss or damage due to customer error or the supply of incorrect shipping details will be with the customer. 

ProteanArt products offered for sale on The Site are shipped to order and only when full payment is completed.  Any delays in the processing of payment will result in a delay to the production and dispatch of  an order.

4) The Supply of Goods and your Right to cancel

All ProteanArt products are supplied as per the descriptions, specifications and according to the images published on The Site only.  Any products purchased on The Site will be subject to specific and stringent option selections, per product, per sale, which are finalised by customers within their ‘Cart’ and paid for at ‘Checkout’.  

All customers are advised that selections made in this purchase process are taken as the specific parameters for orders and products, and it may not be possible to change these parameters once an order is placed, or a product has been made.

As a general rule, production of orders will be commenced immediately goods have been ordered and dispatch of goods will normally be within 1-2 days.

During busy periods this time scale may extend to 4 -7 days. 

All customers have the right to cancel their orders under the The Distance Selling Regulations which gives consumers extra protection when buying online. 

You have the right to cancel the purchase of goods without having to give a reason within 14 working days.[*] 

If you are in possession of the goods you are under the duty to retain them and take reasonable care of them. If cancelling your order you must return the goods back to us to our contact address at your own cost (unless we delivered the item to you in error or the item is notified as defective - photographic evidence may be required) as soon as possible after you have notified ProteanArt of your intent to return.  

We reserve the right to make a charge not exceeding our direct costs of recovering the goods if you do not return the goods or return them at our expense. 

Once you have notified us that you wish to return any goods and those goods are returned to ProteanArt, any sum debited to us will be refunded to you as soon as possible and in any event within 30 days of your cancellation providing the goods have been returned.

[*]You DO NOT have any right to cancel a purchase of goods made specifically to your specifications, that are highly customised, ‘made to order’ or that are personalised.

NB: some items on The Site will fall into this category, but ProteanArt try to work with customers to find a reasonable solution of return or exchange for any wholly unpersonalised items.

Products that are personalised or made to your specifications are classified as ‘Non-returnable goods’.

5) Notices

All notices you send us must be sent to the contact details on this site. We may give notice to you at either the email or postal address you provide to us when making a purchase. (Notice will be deemed received and properly served 24 hours after an email is sent or three days after the date of posting of any letter.) In providing the service of any notice, it will be sufficient to prove, in the case of a letter, that the letter was properly addressed, stamped and placed in the post and, in the case of an email that the email was sent to the specified email address of the addressees.

6) Guarantees

All products made by ProteanArt are guaranteed for 1 year from the date of purchase against any fault in construction or defect that can be reasonably deemed to interfere with the proper functioning of the product. 

Products sold by ProteanArt, but not made by ProteanArt, such as Art Materials should be checked on receipt of delivery. If there is a discrepancy, fault or error with these goods please contact ProteanArt within 3 working days and we will endeavour to help. Art Materials purchased from ProteanArt are only guaranteed against fault or defect that can be reasonably deemed to interfere with the proper functioning of the product if the products are unused and in original packaging/wrapping. Any Guarantee will be subject to an assessment by ProteanArt that the Art Materials have been stored correctly, are (to a reasonable extent) practically unused and any guarantee will not exceed 1 year from the date of purchase.

All guarantees given are at the sole discretion of ProteanArt  Your statutory rights are not affected.

Claims for non-delivery, damaged or pilfered goods during delivery must be made within 7 days of invoice date. Claims made outside this period cannot be accepted. Carrier notes must be marked ‘damaged’ if a claim is to be considered; notes marked ‘unchecked’ are not acceptable.

All goods are offered subject to availability.

All sizes and weights quoted are approximate.

7) Conclusion

These Terms and Conditions are governed by English law. 

Any contract for the purchase of goods from this Site and any dispute or claim arising out of or in connection with any such contract will be governed by English law.  You and ProteanArt both agree that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident in Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident in Scotland you may also bring proceedings in Scotland.
